Terms of Service

Effective date: July 16, 2026

These Terms of Service (“Terms”) govern your access to and use of Testify (the “Service”), an adaptive LSAT preparation tool. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Testify provides LSAT study tools, including original practice questions, AI-assisted explanations and tutoring, skill diagnostics derived from practice-test results you upload, and progress tracking. The Service is a study aid. It is not affiliated with, endorsed by, or licensed by the Law School Admission Council (LSAC), and it does not administer or score the actual LSAT.

All practice questions in the Service are original works created for Testify. They are not actual LSAT questions and are not derived from them.

2. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current. One account per person; accounts are personal and may not be shared or transferred.

3. Subscriptions, trials, and billing

The Service offers a free plan with usage limits and paid plans (“Plus” and, when available, “Pro”) with expanded access. Prices, plan features, and limits are described on our pricing page and may change; changes apply prospectively and we will give notice before a price change affects an active subscription.

Paid plans may be offered as recurring subscriptions or fixed-length passes. Recurring subscriptions renew automatically until canceled. You can cancel at any time; access continues through the end of the paid period. Except where required by law, payments are non-refundable, but if something went wrong, contact us — we try to be fair.

Free trials, founding-member pricing, and promotional discounts are offered at our discretion, may have their own stated conditions, and may be modified or withdrawn for new participants at any time. Payments are processed by a third-party payment processor (Stripe); we do not store your full card details.

4. Your content

You may upload content to the Service, such as practice-test score reports, and you may produce content while using it, such as notes and chat messages with the tutor (“User Content”). You retain ownership of your User Content. You grant us a limited, non-exclusive license to host, process, and display your User Content solely to operate and improve the Service for you.

Do not upload content you do not have the right to share. In particular, do not upload the text of actual LSAT questions or other copyrighted test content; score reports are processed for performance metadata only.

5. Acceptable use

You agree not to:

  • scrape, harvest, bulk-download, or systematically extract questions, explanations, or other Service content;
  • resell, redistribute, or publicly republish Service content, or use it to build or train a competing product or model;
  • share accounts, circumvent usage limits or access controls, or probe or disrupt the Service’s security or infrastructure;
  • use the Service to infringe others’ rights or violate applicable law;
  • misrepresent Testify as affiliated with or endorsed by LSAC.

We may suspend or terminate accounts that violate these Terms, with notice where practicable.

6. Our content and license to you

The Service and its content — including questions, explanations, software, design, and branding — are owned by Testify or its licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own LSAT preparation. No other rights are granted.

7. AI-generated content

Portions of the Service, including practice questions, explanations, and tutor chat, are generated with the assistance of artificial intelligence and are reviewed through automated validation. AI output can contain errors. The Service is a study aid, not a guarantee of any score outcome, and does not provide professional advice of any kind. If you find a defective question or explanation, please report it and we will review it.

8. Account deletion

You may delete your account at any time from your account settings. Deletion signs you out and disables access immediately and cancels any active subscription. Your data is retained in a deactivated state for approximately 30 days, during which you can contact us to restore the account, and is then permanently purged. You may request an export of your data before deleting.

9. Termination and changes to the Service

We may modify, suspend, or discontinue features of the Service. If we discontinue a paid feature you have paid for, we will provide a pro-rated refund for the unused period. We may terminate or suspend your access for material breach of these Terms.

10. Disclaimers of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT ANY PARTICULAR LSAT SCORE, SCORE IMPROVEMENT, OR ADMISSIONS OUTCOME. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTIFY AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY US DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You will indemnify and hold Testify harmless from claims arising out of your User Content, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of [GOVERNING-LAW STATE — TO BE CONFIRMED WITH COUNSEL], without regard to conflict-of-laws rules. Courts located in [VENUE — TO BE CONFIRMED WITH COUNSEL] will have exclusive jurisdiction, and each party consents to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you may have under the law of your place of residence.

14. Changes to these Terms

We may update these Terms from time to time. For material changes we will give notice (for example by email or an in-app notice) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
